What is this document and why should you read it?

This Privacy Notice describes how and why the ETAP and IGE+XAO group companies (referred to in this Notice as “ETAP”, “we”, “our” and “us”) collect, use, and share your personal information:

  • when you use our ETAP Website(s)
  • when you contact and interact with us
  • when collected offline, including at events, surveys, and customer evaluations
  • when received from third party sources, including partners and vendors

It will also inform you of your rights relating to your personal information.


1. Who we are and scope

ETAP Website” refers to our ETAP website at , , and .

The ETAP and IGE+XAO group companies are listed here (as may be updated from time to time) and are members of the Schneider Electric group.

We act as the controller for your personal information. This means that we are responsible for deciding how and why your personal information is collected, stored, and used (referred to as “processing”).

If you are a job applicant who has provided personal information for recruitment purposes, or an employee, contractor, or other individual working with us, you would have previously received a copy of our relevant recruitment privacy notice. If you do not have a copy, please contact us at legal@etap.com and we will promptly provide one.

2. What personal information do we collect about you?

Personal information” means information that is about you and identifies you as a living individual. A name, address, and contact details are all examples of personal information if they identify you or another person.

The personal information we collect about you and how it is used depends on how you have contacted or interacted with us (or a third party with permissions to share your personal information with us).

If you provide us with personal information about others, such as family, friends, or other associates, you must seek their permission in the first instance and share a copy of this Privacy Notice with them.

The personal information that we may process includes:

  • Identification and contact details such as your name, address, e-mail address or other online identifier, telephone number, mobile number, job title, department, and company/employer
  • Technical personal information such as your username, user ID, authentication-related information, security and credential data (such as hints or other verification information), mobile device information, hostname, Internet Protocol (IP) address, and the MAC address of the device that is used to access our products and services.
  • Details of your visits to our Website(s) such as login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform, as well as details of how you navigated our website, what pages you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), geolocation, sensory data (such as audio information for recorded technical support interactions), and any phone number or email address used to contact our customer service department.
  • Information in the context of your contact and interactions such as with the ETAP Website(s), chatbots on the ETAP Website(s), and with our systems and technical, product, and support teams via the ETAP Website(s), including when you complete and submit forms, subscribe, register, enroll, request support, or log in to your account, and the choices that you make, including your privacy settings, browsing behavior, and the products and features that you use and how you use them, as well as records or recordings of chatbot interactions, emails, forms, documents, or links submitted.
  • Information gathered during other interactions such as information provided through support functionality or otherwise provided to us or generated by us, as necessary, to provide the ETAP Website(s) and related products, services, facilities, and systems, including voice recordings or transcripts.
  • Your feedback on ETAP Website(s), our products and services, and events, whether received by ETAP directly or via third parties with permission to share this feedback with us.
  • Marketing and communications preferences such as consents, permissions, or preferences that you have specified, such as whether you wish to receive direct marketing by subscribing to receive ETAP news and media alerts.
  • Payment and purchasing details such as when you register for events online or for products or services you may receive from us.
  • Details you choose to provide, such as by filling in a form on our Website(s), including subscribing to newsletters and alerts, registering for a conference, or any other personal information about you and other individuals that you voluntarily submit to us.
  • Sensitive personal information, where strictly necessary, appropriate, and legally permitted, ETAP may collect and process special categories of personal data. This may be necessary to support your access to and use of our ETAP Website(s), products and services, facilities, and systems, as well as to provide communications in accessible formats and to offer you additional support.
  • General meetings information we my collect when we meet you face to face, such your participation at our events or access to our offices and facilities, which may include photographs and video recordings.

In some circumstances, we can only provide our products, services, or access to the ETAP Website(s) and related systems, facilities, and/or events if you provide us with certain personal information.


3. How we obtain your personal information

We use different methods to collect personal information from and about you, including:

  • Direct interactions: you may give us your information when you interact with us, such as when you:
    • complete the ‘Contact Us’ form or subscribe to our newsletter
    • interact with an ETAP chatbot
    • register for or participate in one of our online, hybrid, or in person events, including conferences, webinars, trade shows, and product launches
    • use our helpdesk or support channels
    • request ETAP content or product and services information
    • enroll in cloud-based training or other our product trainings
    • use the Schneider Electric Trust Line to raise a concern
    • visit our offices
    • contact us via other third-party platforms
  • Third parties: we may receive personal information about you from various third parties such as:
    • from the organization with which you are employed, contracted or affiliated in order to activate and manage your access to our products and services;
    • our affiliates and subsidiaries within the ETAP and/or Schneider Electric group companies;
    • from our business partners and third-party suppliers that we work with. For example, we may have your name and contact details passed on to us by third parties such as our prospective customers, partners, suppliers, marketing partners, industry publications, or content syndication partners. We may also receive, in such contexts, professional or employment-related information about you.
  • Automated technologies or interactions:
    • As you interact with the ETAP Website(s), we may automatically collect technical personal information about your equipment and how you navigate our Website(s) through cookies, server logs, and similar technologies. We may also receive technical personal information about you when you interact with ETAP content delivered through other websites that use our cookies or similar technologies. When you receive newsletters or promotional e-mails from us, we may use web beacons, customized links, or similar technologies to determine whether the e-mail has been opened and which links you click, in order to provide more focused e-mail communications or other information. 4. Why we collect your personal information

Depending on how you interact with us, we collect and use your personal information for the following purposes:

  • to respond to your communications, queries and feedback
  • to manage our relationship with you, our customers, and other third parties, including contract administration, supplier relationship management, and receipt of products and services provided to ETAP
  • to create, manage, and administer your registrations, subscriptions, forms, applications, and accounts on ETAP Website(s)
  • to understand how the features and functions of the ETAP Website(s) are used so that we can improve our website, products and services, marketing, customer relationships, and user experiences
  • to audit and monitor the use of the ETAP Website(s) as part of our efforts to keep our ETAP Website(s) safe and secure
  • to administer, review, and improve our ETAP Website(s), products and services, and for related internal operations, including troubleshooting, data analysis, testing, research, statistical analysis, and survey purposes
  • to contact you for marketing purposes, including sending you information about news, events, surveys, and feedback (see 8. How we use your personal information for marketing for more details)
  • to allow you to participate in interactive features of our products and services, promotions, and surveys when you choose to do so
  • to measure or understand the effectiveness of advertising we serve to you and others, and to deliver relevant advertising to you
  • to manage and administer our business and ETAP brands
  • to facilitate your visit to our offices or other sites, including for visitor management and security purposes

5. Legal basis for processing personal information

Depending on how and why we process your personal information, we may rely on the following legal bases:

  • It is necessary to perform a contract with you.
  • It is necessary for our legitimate business purpose (such as the administration and management of our business and the improvement of our products and services) and our doing so will not unduly interfere with your privacy rights.
  • It is necessary to comply with our legal obligations, a court order, or to exercise or defend a legal claim.
  • Your consent, which you can withdraw at any time. Please see 12. Your rights regarding your personal information for more details. We will explain at the time of collection what information we need to collect and the reason why you are asked to provide such information.

6. Cookies and Interest–based advertising

We use cookies and similar tracking technologies, including web beacons and smart pixels, to uniquely identify your browser and to use personal information about you, your preferences, or your device. When you visit the ETAP Website for the first time, you will be presented with a cookie banner which allows you to accept or decline cookies. To update your cookie preferences, click on the cookie-settings option displayed in the lower left corner of our Website(s) to edit your settings.

We use advertising services, such us advertising networks, digital advertising partners and social media platforms, to provide you with advertising about our products and services tailored to your individual interests. This is called interest-based advertising. Both ETAP and third-party websites that participate in ad networks may collect information about your online activities over time. This enables us to target our messaging to you through demographic, interest-based, and contextual means and help us track the effectiveness of our marketing campaigns. You can manage your advertising and cookie preferences by selecting the cookie-settings option displayed in the lower left corner of our Website(s). You will need to set your preferences from each device and each web browser you use.


7. License compliance technology

ETAP takes all legal steps to eliminate piracy of our software products and to protect our intellectual property rights. In this context, ETAP software may utilize various technologies, such as security mechanisms that can detect the installation or use of illegal copies of the software and collect and transmit data about those illegal copies using ETAP license compliance tools.

If ETAP software is illegally installed or used, data (including limited categories of personal information) of the affiliated user accounts may be collected and processed by ETAP in the course of carrying out its compliance activities. Our compliance teams use this information, together with other information on record, to confirm the details of the corporate entity involved and the approximate geographic region where the infringing incident has occurred.

ETAP uses this functionality to pursue its legitimate interest in protecting its business assets and apprehending parties that violate such rights.


8. How we use your personal information for marketing

We may use your personal information to send you communications about our products or services that we believe you may be interested in. This may include marketing relating to products or services offered by other companies within the ETAP and IGE+XAO group companies that we think you may be interested in. We may send you marketing communications by email or SMS.

We will add your details to our marketing database if:

  • you make an inquiry about our products or services
  • you attend an industry-related event
  • you buy our products or services
  • you have told a third party that you would like them to pass us your contact details so that we can send you updates about our products or services
  • you have registered for a product and/or an account with us
  • you have consented to receiving marketing communications from us

You can ask us to stop sending you marketing messages at any time by following the opt-out links in the marketing message sent to you or by contacting info@etap.com.

Third-party marketing

We do not share personal information with any company outside the ETAP and IGE+XAO group of companies for direct marketing unless it is with your permission, such as when you direct us to share your personal information with a conference organizer or request us to share your details with one of our business partners.


9. Who we share your personal information with

We will only disclose your personal information to:

Internal third parties

  • companies within the Schneider Electric group, where it is necessary to administer and manage group functions or for shared group services purposes (such as administration, systems maintenance and support, systems and physical security, and hosting of data)

External third parties

  • third-party suppliers, including sub-contractors for business administration, support, processing, services, or IT purposes
  • business partners, suppliers, and sub-contractors we work with to provide you with products or services that you have requested from us
  • analytics or search engines, that enable us to optimize and improve your experience of ETAP Website(s);
  • our professional advisors (including, without limitation, tax, legal, insurance, or other corporate advisors who provide professional services to us)
  • in the event that we sell or buy any business or assets, we may disclose your personal data to the prospective seller or buyer of such business or assets
  • government, regulatory, and law enforcement bodies where we are required to do so in order to:
    • comply with our legal obligations
    • exercise our legal rights (e.g. to pursue or defend a claim)

Where we engage with a supplier or other third party to process your personal information, we undertake due diligence to ensure that your personal information is appropriately protected and enter into written agreements imposing appropriate security standards on them.


10. How we protect your personal information

We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used or accessed in an unauthorized way, altered, or disclosed.

In addition, we limit access to your personal information to those staff, agents, contractors, and other third parties who have a business need to know. They will only process your personal information in accordance with our instructions and are subject to a duty of confidentiality.

Please remember that you are responsible for keeping your passwords secure. If we have given you (or you have chosen) a password which enables you to access certain parts of our Website(s), you are responsible for keeping this password confidential. Please do not to share your passwords with anyone.

Sending information via the internet is not always secure. While we do our best to protect your personal information, we cannot guarantee the security of data sent to our Website(s). Therefore, you send us personal information at your own risk. We will nonetheless use strict procedures and security features to try to prevent unauthorized access.


11. Which countries we transfer personal information to?

Due to our global operations and support services, your personal information may be transferred to locations outside the jurisdiction in which you provided it.

If there are cross-border restrictions on transferring personal information we will ensure that adequate safeguards are in place to ensure such transfers are permitted in accordance with data protection legislation. 12. How long we keep your personal information

We have a data retention policy which specifies how long records, including personal information, must be retained.

We will retain your information for so long as it is necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, tax, regulatory, or reporting requirements. Please contact us if you require any further information.

Unless otherwise required or permitted by law, when the applicable retention period expires, we will securely destroy your personal information.


13. Third party websites

Our Website(s) may contain links to websites operated and maintained by third parties over which we have no control. Privacy policies on such linked sites may differ from ours. You access such linked sites at your own risk. You should always read the privacy policy of a linked site before disclosing any personal information on that site.


14. Your rights regarding your personal information

Access: You can ask us at any time to provide you with a copy of your personal information.

Request to transfer: In relation to personal information you have supplied to us, and which we hold for the purpose of entering into a contract with you on the basis of your consent, you are entitled to ask us for a copy of this information in a structured, commonly used, and machine readable format so that you can reuse it or share it with other organizations.

Inaccurate or incomplete: If you think the personal information we hold about you is inaccurate or incomplete, you can ask us to correct or complete it.

Object or restrict: In some circumstances, you also have the right to object to our processing of your personal information and can ask us to restrict our use of your personal information or to delete it.

There are some exceptions to these rights, however. For example, it will not be possible for us to delete your personal information if we are required by law to keep it or if we hold it in connection with a contract with you. Similarly, access to your personal information may be refused if making the information available would reveal personal information about another person or if we are legally prevented from disclosing such information.

Withdraw consent: Where we rely on your consent to process your personal information, you have the right to withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing conducted prior to your withdrawal, nor will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

15. California Privacy Rights

If you are a California resident, you have rights under the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Acts of 2020 (CPRA), from hereon referred to as CCPA. The following provisions apply in California in addition to the provisions of the Privacy Notice set out above.

Rights relating to your personal information

As a California resident, you have the right to:

  • Know: to request that we disclose the categories of personal information we collect, use, disclose, sell, or share
  • Request deletion or correction of your personal information
  • Opt out of the sale or sharing of your personal information, including:
    • opting out of the use of cookie data for targeted advertising
    • opting out of the use of your email address for marketing communications and targeted advertising

Sale and Share

We do not sell personal information as the term “sell” is commonly understood. Under the CCPA, a sale is defined to include disclosures of personal information to a third party for monetary or other valuable consideration. Certain third parties may collect or receive information from us so that we can provide you with access to the products and services covered by this notice. These third parties do not use your personal information for other purposes than those we contracted them for.
